Terms of Service
ROSSOautomobili Terms of Service and Community Rules
October 9, 2026
1. Acceptance; contracting entity; scope
These Terms govern access to ROSSOautomobili.com, its forums, member profiles, messages, media, subscriptions, sponsorships, classifieds, advertising listings and other services operated FerrariChat, LLC ("ROSSOautomobili," "we," "us"). By accessing or using the Services you agree to these Terms and incorporated Community and Classified Rules. If you disagree, do not use the Services. You must be at least 18 and legally competent to agree; an entity representative warrants authority to bind that entity. Users previously suspended or banned may not return without written authorization. ROSSOautomobili is a separately operated contracting entity; references to related brands or integrations do not make those businesses parties to this agreement or transfer ownership of ROSSOautomobili assets. Specific third-party products are governed by their own agreements. We may amend Terms with reasonable notice by posting or email; where required, obtain affirmative consent. Continued use after effective notice constitutes acceptance where lawful.
2. Accounts, security, electronic communications
One account per individual; no aliases to evade restrictions. Usernames need not be legal names, but information requested for registration, billing, identity verification or sales must be truthful, current and complete. Protect credentials, do not share accounts, and promptly report unauthorized access. You are responsible for activity under your credentials to the extent permitted by law. Notices may be delivered by account notice, email or other legally sufficient means. Transactional notices may be necessary to operate the Service. Marketing emails and texts require applicable consent and offer legally required opt-outs.
3. ROSSOautomobili as community and classified venue
ROSSOautomobili hosts user discussions, information, advertisements and introductions; except where ROSSOautomobili expressly signs a separate written agreement as principal, it is not the buyer, seller, broker, dealer, escrow agent, inspector, guarantor or agent for member transactions. Sellers and buyers alone are responsible for ownership, title, liens, condition, authenticity, pricing, legal compliance, payment, transport, delivery, returns and disputes. ROSSOautomobili does not verify every listing, vehicle history, member identity, technical assertion or seller's ability to deliver. Use independent inspections, title verification and reputable escrow as appropriate. ROSSOautomobili is not obligated to mediate disputes or ensure transaction performance. Any direct sale, consignment, brokerage, auction, financing, insurance, escrow or payment service offered by ROSSOautomobili or another provider requires separate express terms identifying the responsible provider.
4. Sales taxes and fees
Participants determine, collect, report and remit applicable sales, use, luxury and other taxes on their transactions, except where law requires ROSSOautomobili or a designated marketplace facilitator to do so. Prices, subscriptions, sponsor rates, posting limits, renewal and cancellation terms are disclosed at purchase or in posted plans. Fees are in U.S. dollars unless stated otherwise. Payment authorization extends only to disclosed fees and authorized renewals. Applicable refund, cancellation and auto-renewal rights are not waived.
5. Limited license to access; prohibited extraction
ROSSOautomobili and its licensors retain rights in its software, branding, design, editorial content, organization and compilation of materials, excluding members' independently owned User Content. We grant a limited, personal, revocable, nonexclusive, nontransferable, nonsublicensable license to access and use the Services for their intended purposes. Without prior written permission, you may not resell access; commercially reproduce or syndicate site content; scrape, crawl, bulk download, mine or extract forum archives or member data; use bots to collect training datasets for AI models; bypass rate limits, access controls or bans; reverse engineer where prohibited by law; interfere with security; harvest member contact information; or misuse trademarks. Ordinary browsing, search-engine indexing expressly authorized by us, and activity protected by applicable law are not prohibited. ROSSOautomobili may restrict access, listings or features to protect the Service.
6. Member conduct and community moderation
Members must not post unlawful, defamatory, threatening, harassing, discriminatory, obscene, fraudulent, infringing, malicious or privacy-invasive material; impersonate others; publish private communications or identifying information without permission or lawful basis; spam, troll, flame, manipulate engagement, cross-post duplicates, distribute malware, or disrupt discussions. Moderators may relocate threads to appropriate forums, including designated out-of-bounds discussions; edit or remove posts, signatures, avatars and links; issue warnings or suspensions; permanently ban accounts; or refuse content in their discretion, subject to applicable law. No member is entitled to an appeal, advance warning or publication of reasons. We may but need not monitor content; reporting violations is encouraged and does not guarantee action. Avoid spoiler titles and use spoiler tools. Members should retain their own copies of important posts.
7. Classified advertising and commercial activity
All commercial activity requires the applicable sponsorship or commercial/classified subscription. Dealers, brokers, sponsors and other commercial sellers may not post in individual classified sections. Current annual limits: Rossa subscribers: three car ads and twenty parts/items ads; Silver subscribers: one car ad and five parts/items ads; Classified subscribers: unlimited ads in designated commercial sections, subject to fair-use, technical and other published restrictions. An individual subscriber may post no more than one new ad per day per unique item. One listing per unique item; bundles of matching or related items sold as a single lot are permitted, but general storefront threads are not. No meaningless bumping; substantive new photos, price or material terms updates may refresh a listing and count toward daily limits. Answers to genuine questions do not count. Sellers must state an asking price. In classified threads, replies must be legitimate questions or accurate first-hand information about the item or seller; offers should be sent privately. Unlicensed sale or manufacture of non-OEM goods using protected logos, trademarks or copyrighted designs is prohibited; proof of authorization may be required. Moderators decide whether conduct is commercial and may remove listings or impose restrictions. Current posted classified rules and product-specific checkout terms control if they explicitly differ from numerical limits in this section; material changes should be clearly announced.
8. User content; ownership and license
You retain ownership of your original posts, images, videos, messages, reviews and other User Content, subject to rights of others. You warrant you possess rights necessary to submit it. By posting or transmitting User Content to public or member-accessible areas, or submitting it to ROSSOautomobili-controlled social accounts, you grant ROSSOautomobili a nonexclusive, worldwide, royalty-free, perpetual, irrevocable, transferable, assignable and fully sublicensable license to host, store, reproduce, edit, adapt, translate, create derivative works, publish, distribute, publicly display and perform, archive, promote, advertise, commercially exploit and otherwise use that content in any medium, whether now known or later developed, including licensed syndication and AI-related uses, subject to applicable law and our Privacy Policy. This license does not convey ownership of your underlying copyright. For private messages, the license is limited to providing, securing, administering and legally protecting the Services, unless a participant separately authorizes broader use. Deletion of an account does not automatically retract licenses previously granted or remove quotations, archived discussions or lawfully distributed copies. Personal data is handled under the Privacy Policy and applicable privacy rights.
9. Feedback
Suggestions, feature ideas, bug reports and other feedback specifically provided about ROSSOautomobili or its Services may be used, adapted and commercialized without compensation or acknowledgment. To the extent legally permitted, you assign ROSSOautomobili all intellectual property rights in such feedback; if an assignment is ineffective, you grant an irrevocable, perpetual, worldwide, sublicensable, royalty-free license for those purposes. Ordinary forum discussion and technical contributions are User Content, not Feedback solely because they suggest improvements.
10. Copyright, trademarks and notices
Respect intellectual property, privacy and publicity rights. ROSSOautomobili, its name, logo and site marks may not be used without permission; third-party marks remain their owners' property. Copyright owners may send a written notice identifying the work, allegedly infringing material and its location, complainant contact details, signature, good-faith statement and declaration under penalty of perjury to admin@ferrarichat.com. We may remove content and terminate repeat infringers. Counter-notices and restoration requests will be processed as required by law.
11. Third-party services, sponsors and affiliate links
Links, embedded media, payment services, advertisers, sponsors, affiliate commerce links and integrated marketplaces may be operated by third parties. ROSSOautomobili does not endorse or warrant their products, availability, security or representations merely by linking or displaying advertising. Your use of third-party services is at your risk and subject to their own terms and privacy notices. ROSSOautomobili may receive advertising, referral or affiliate compensation, including commissions on qualifying purchases, as disclosed.
12. Privacy, personal information and SMS
The Privacy Policy governs collection, use, retention, transfer and disclosure of personal information. Public posts may be copied or republished by others. Staff may review public and reported content and use security or spam-verification providers. Private messages are not guaranteed to be inaccessible to administrators or service providers where access is lawful and necessary for operation, safety, enforcement or legal process; the Privacy Policy controls. Where ROSSOautomobili actually offers SMS, enrollment requires the legally required consent; message frequency varies, carrier charges may apply, and recipients may reply STOP to opt out and HELP for help. Do not treat acceptance of these Terms alone as consent to marketing texts.
13. Disclaimer of warranties and technical information
TO THE FULLEST EXTENT PERMITTED BY LAW, SERVICES, POSTS, TECHNICAL ADVICE, MARKET DATA, LISTINGS, PHOTOGRAPHS AND OTHER CONTENT ARE PROVIDED “AS IS,” “AS AVAILABLE” AND “WITH ALL FAULTS,” WITHOUT EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SECURITY, UNINTERRUPTED OPERATION OR FREEDOM FROM MALWARE. ROSSOautomobili does not warrant that member technical, mechanical, legal, financial, medical or driving advice is accurate or safe. Independent qualified professional inspection and advice are recommended. Nothing excludes nonwaivable statutory rights.
14. Third-party transaction release
To the fullest extent allowed by law, members participating in third-party transactions release ROSSOautomobili and its protected persons from claims arising solely from disputes between transaction participants, including misdescription, nonpayment, delivery, title, authenticity, condition or fraud by another user. This release does not apply to ROSSOautomobili's own independently actionable conduct or liabilities that cannot lawfully be released. California residents expressly waive California Civil Code section 1542 as to released claims to the extent a valid waiver is permitted, after reviewing the statute's protections.
15. Indemnification
To the extent permitted by law, you will indemnify, hold harmless and, at ROSSOautomobili's option, defend ROSSOautomobili, its actual affiliates and subsidiaries (if any), and their respective members, owners, managers, directors, officers, employees, moderators, agents and contractors against third-party claims, damages, losses, liabilities and reasonable legal fees arising from your User Content, Feedback, breach of these Terms, infringement, unlawful conduct, or transactions you conduct using the Services. ROSSOautomobili may control defense and settlement, subject to applicable law and reasonable cooperation. No settlement imposing personal obligations on you may be entered without your consent where legally required.
16. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ROSSOautomobili AND ITS PROTECTED PERSONS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, LOST PROFITS, DATA, GOODWILL OR BUSINESS INTERRUPTION ARISING FROM THE SERVICES, CONTENT OR THIRD-PARTY TRANSACTIONS, WHETHER IN CONTRACT, TORT OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY. TO THE FULLEST EXTENT PERMITTED BY LAW, INSIDEEVSFOFUM'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES WILL NOT EXCEED US $100. These limits do not exclude liability or remedies that applicable law prohibits excluding, and do not override express remedies in a separately signed agreement.
17. Individual arbitration and class-action waiver
PLEASE READ: EXCEPT WHERE PROHIBITED BY LAW, DISPUTES ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL BE FINALLY RESOLVED BY BINDING INDIVIDUAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION UNDER ITS APPLICABLE CONSUMER RULES, SUBJECT TO THE FEDERAL ARBITRATION ACT. A SINGLE NEUTRAL ARBITRATOR MAY GRANT RELIEF AVAILABLE IN COURT ON AN INDIVIDUAL BASIS. The parties waive jury trial for arbitrable disputes. Unless law or AAA rules require otherwise, in-person hearings will be held Dade County, with remote or local hearings as required by applicable rules. Filing fees are allocated under AAA rules and applicable law. Claims eligible for small-claims court may be filed there if permitted by law. Either party may seek temporary court relief to protect intellectual property or prevent unauthorized access, to the extent legally permitted. EACH PARTY BRINGS CLAIMS ONLY IN ITS INDIVIDUAL CAPACITY, NOT AS A CLASS OR REPRESENTATIVE PLAINTIFF OR MEMBER, TO THE EXTENT PERMITTED BY LAW. If a court determines the class waiver unenforceable for a particular claim and that claim cannot be arbitrated individually, the affected claim will proceed in court; the remainder survives to the extent permitted. Arbitration provisions survive account closure.
18. Termination and content retention
ROSSOautomobili may suspend, limit or terminate accounts, access, subscriptions, posting privileges and listings at any time, with or without notice or cause, subject to applicable law and paid-service commitments. Members may request closure through the published contact method. Closing an account does not guarantee deletion of historical public contributions, transaction records, or material needed for compliance, dispute resolution or security. Provisions intended to survive, including licenses, disclaimers, liability limits, indemnity and dispute resolution, survive termination.
19. Governing law, venue and claim deadlines
Florida law governs these Terms without regard to conflicts rules, except to the extent superseded by mandatory law or the Federal Arbitration Act. Courts in Dade County have jurisdiction over nonarbitrable disputes to the extent permitted by law. Any contractual claim-filing period is the shorter of one year after accrual or the period allowed by law only to the extent enforceable; this does not shorten any nonwaivable statutory deadline. The United Nations Convention on Contracts for the International Sale of Goods does not govern these Terms.
20. Notices and accessibility
Legal notices to ROSSOautomobili must be delivered to admin@ferrarichat.com 5972 NE 4th Avenue, Miami FL 33137. We may provide notices by email, account messaging, postal mail or conspicuous site notice as permitted by law. Users needing an accessible version of these Terms may contact that address; reasonable requests will be accommodated.
21. Miscellaneous
If any provision is invalid, the remainder remains effective except as specifically provided in the arbitration section. These Terms, the Privacy Policy and expressly incorporated forum, classifieds and paid-service rules form the complete agreement for the covered Services, superseding prior site terms but not separate signed contracts. Users may not assign rights without ROSSOautomobili's written consent; ROSSOautomobili may assign these Terms in connection with an authorized business transaction, subject to law and its corporate governance documents. Failure to enforce a provision is not waiver. There are no third-party beneficiaries except expressly protected persons. U.S. hosting and international transfers are described in the Privacy Policy; rights and notices required by privacy law remain effective. Nothing in these Terms alters ROSSOautomobili's ownership, corporate governance or agreements with other companies.
